Article 1 - General

These General Terms and Conditions apply to all use of the YAMUELI.nl website (website) and to all offers and quotations from YAMUELI and to all agreements concluded between you and YAMUELI.nl.

Article 2 - Offers

2.1 All offers on the website are without obligation, unless expressly stated otherwise. Offers do not automatically apply to repeat orders.

2.2 YAMUELI.nl cannot be held to its offers if you could reasonably have understood that the offer contains an obvious mistake or typo.

2.3 The prices stated on the Website include VAT. A contribution to the shipping costs will be stated separately to you prior to ordering. This contribution may depend on the order size. The contribution to the shipping costs will not be refunded upon return.

Article 3 - Data

3.1 You must ensure that your details, including, but not limited to, email address, address details and bank account number are complete, correct and up to date. You also warrant that you are legally authorized to use the website in any manner.

3.2 YAMUELI.nl guarantees that all your data will be treated with the utmost care and that this data will not be passed on to third parties, resold or otherwise made available without your prior consent.

Article 4 - Establishment of agreement

4.1 The agreement is concluded upon receipt of your order at YAMUELI.nl.

4.2 Changes to an agreement are only possible if this has been expressly accepted by YAMUELI.nl.

Article 5 - Delivery

5.1 The order will be delivered to your home, unless you have indicated on the Website that you will collect the order yourself or that the order must be delivered to a different delivery address. Delivery is usually within 1 to 2 working days.

5.2 You are obliged to accept the purchased products at the time they are made available to you.

5.3 If you refuse to accept delivery or fail to provide information or instructions necessary for delivery, the products intended for delivery will be stored at your risk and expense.

5.4 If you have provided an incorrect address for delivery, the additional shipping costs will be at your expense.

Article 6 - Risk during transport

During the transport of the products, YAMUELI.nl does not bear the risk in the event of damage, theft or loss of the products. This risk passes to you at the time of delivery of the products.

Article 7 - Reflection period

7.1 You have the right to terminate the agreement without giving reasons within 14 days of receipt of the product in question. YAMUELI.nl will then return the purchase amount within 30 days of receipt of the returned product, provided that the product in question is undamaged, not worn, washed or otherwise clearly used or processed and is provided with the original packaging and (info) cards.

7.2 The costs for returning the product in question are at your own expense.

7.3 Beauty products, beachwear, lingerie and scarves will not be taken back by YAMUELI.NL for hygienic reasons.

Article 8 - Guarantees

8.1 YAMUELI.nl guarantees that the products to be delivered meet the specifications stated on the Website.

8.2 You must inspect the delivered product at the time of delivery, but in any case within the shortest possible time. You must investigate whether the quality and quantity of the delivered goods correspond to what was agreed, or at least meet the requirements that apply in normal (trade) traffic.

8.3 YAMUELI.nl is not responsible for items after they have been worn or washed. Even if a fabric starts to pill, the responsibility remains with the customer.

Article 9 - Retention of title

YAMUELI.nl remains the full owner of the delivered product until the purchase price has been paid in full.

Article 10 - Payment

10.1 When concluding the agreement, you determine how payment will be made. For example, you can choose to pay with your credit card or transfer to the account.

10.2 YAMUELI.nl will only deliver the product once payment has been received. This applies to all payments. Sofort banking has a processing time of two weeks, we will send the order after we have received payment.

Article 11 - Collection costs

If you do not meet your payment obligations, YAMUELI.nl can claim not only the statutory interest on the amount due, but also all reasonable costs that YAMUELI.nl must incur to obtain its claim out of court. The collection costs are in any case set at 15% of the principal amount; If YAMUELI.nl can demonstrate that it has had to incur higher costs, these are also eligible for reimbursement.

Article 12 - Intellectual property rights

12.1 The (intellectual property) rights relating to the Website, including the rights to the texts, images, design, data files, photos and other (still and/or moving) images, formats, software, brands (including domain names) and other materials , rests with YAMUELI.nl, its licensors, the manufacturers of the relevant products and/or third parties to whom YAMUELI.nl is not affiliated. 12.2 You may not make (parts of) the Website available to third parties and/or reproduce it other than by downloading it and viewing it on one computer and/or printing one hard copy.

12.3 In addition, you may not make any changes to the delivered products, unless the nature of the delivered products dictates otherwise or otherwise has been agreed in writing.

12.4 You may only create a hyperlink to the Website if this is done purely for information purposes. Placing a hyperlink for another purpose, such as a commercial purpose, is therefore prohibited.

Article 13 - Liability

13.1 If products supplied by YAMUELI.nl are defective, YAMUELI.nl's liability towards you is limited to what is regulated in these General Terms and Conditions under Article 9 (Guarantees).

13.2 The liability of YAMUELI.nl for direct or indirect damage is in any case always limited to an amount equal to the purchase price of the defective product, unless the damage is due to intent and/or gross negligence, or to improper or improper use by yourself.

13.3 YAMUELI.nl hereby excludes any liability for any damage whatsoever, direct and/or indirect, in any way caused by and/or arising from the inability to use the Website, the fact that certain information on the Website is incorrect, incomplete or not up to date and the unlawful use of the YAMUELI.nl systems, including the Website, by a third party.

Article 14 - Force majeure

Parties are not obliged to fulfill any obligation if they are prevented from doing so as a result of a circumstance that cannot be attributed to their fault and which is not governed by law, a legal act or generally accepted opinion.

Article 16 - Miscellaneous

16.1 Any deviations from these general terms and conditions can only be agreed in writing. No rights can be derived from such deviations with regard to legal relationships entered into later.

16.2 The administration of YAMUELI.nl will serve as proof of the requests and/or orders you have made, unless evidence to the contrary is provided. You acknowledge that electronic communications may serve as evidence.

16.3 YAMUELI.nl is entitled to transfer the rights and obligations under the agreement with you to a third party by a single notification to you.

16.4 If and to the extent that any provision of the general terms and conditions
